A party established in the EU that places on the market an AI system bearing the name or trademark of a party established outside the EU. Importers should verify required documentation, conformity status, provider identity, and contractual protections before placing AI systems on the market.
Under EU AI Act Article 23, importers must verify before placing high-risk AI on the market that the provider carried out the conformity assessment and drew up technical documentation.
An EU subsidiary importing a US-developed high-risk hiring AI into Germany acts as an importer with Article 23 verification duties.
The CE marking requirement extends to AI systems and importers must ensure the marking is affixed in compliance with EU AI Act Article 48.
