Governance and Compliance
A party in the AI supply chain, other than the provider or importer, that makes an AI system available on the EU market. Distributors need change-control discipline because modifying purpose, branding, or instructions may shift obligations or create provider-like responsibilities.
Under EU AI Act Article 24, distributors must verify that high-risk AI bears the required CE marking, accompanying documents, and that the provider and importer have complied with their obligations.
A reseller of AI-enabled medical imaging software in the EU acts as a distributor and may become a provider if it modifies the system's intended purpose.
Under Article 25, any distributor that puts a high-risk AI on the market under its own name or trademark is considered a provider for EU AI Act purposes.
