An AI use considered unacceptable under the EU AI Act, such as certain manipulative, exploitative, social scoring, or unlawful biometric practices. These prohibitions began applying on 2 February 2025. GRC teams should translate prohibitions into intake screening questions, procurement checks, product design rules, and escalation triggers.
Article 5 of the EU AI Act prohibits subliminal manipulative techniques, exploitation of vulnerabilities, social scoring by public authorities, and untargeted scraping of facial images.
Workplace emotion recognition and real-time remote biometric identification in public spaces (with limited exceptions) became enforceable prohibitions on 2 February 2025.
Clearview AI's facial recognition database built from scraped images is a documented example of practices now prohibited under Article 5, fined EUR 30.5 million by the Dutch DPA in 2024.
